TERMINATION BASED ON LACK OF FUNDING. Any contract awarded as a result of this solicitation will be subject to funding and continued appropriation of sufficient funds for the contract. For purposes of this solicitation, the appropriating authority is deemed to be the Boards. Insufficient funds shall be the grounds for immediate termination of this solicitation.

TERMINATION BASED ON LACK OF FUNDING. Xxxx Xxxxxxx Community College is a public institution of higher education and its budget is subject to funding by governmental entities. This contract is subject to the continued appropriation of sufficient funds for this contract by the College’s appropriating authority. For purpose of this contract, the College’s appropriating authority is deemed to be the Board of Trustees of Xxxx Xxxxxxx Community College. Lack of funding shall be grounds for immediate termination of the contract. The College shall promptly provide the seller written notice if a non-appropriation occurs.
