Common use of Termination by Design/Builder for Cause Clause in Contracts

Termination by Design/Builder for Cause. If Owner shall persistently or repeatedly fail to perform any material obligation to Design/Builder for a period of thirty (30) days after receiving written notice from Design/Builder of its intent to terminate hereunder, Design/Builder may terminate performance under the Agreement by written notice to Owner. In such event, Design/Builder shall be entitled to recover from Owner on the terms and conditions and in the amounts as though Owner had terminated Design/Builder’s performance under the Agreement for convenience pursuant to Paragraph 18.7 below.
