Owner Personnel. Owner shall provide to Design/Builder a listing of key project personnel of Owner working on the Project.
Owner Personnel. Developer shall provide Owner at least two (2) Business Days prior notification of the commencement of the Commissioning Procedures. Owner, at its sole expense, may arrange for its representatives (including technical or engineering consultants) to be present at the Site throughout Developer’s conduct of any Commissioning Procedures in order to monitor the taking of measurements to determine the level of performance of the Solar Facility, all in accordance with the Commissioning Procedures.
Owner Personnel. LICENSEE may request from OWNER the equivalent of up to FTEs of R&D resources to help execute the PHASE 3 WORK PLAN, the request to be accepted at OWNER’s sole discretion. The cost for these FTEs will be paid by LICENSEE to OWNER and will be capped for each 12-month period during the TERM, unless otherwise agreed by the PARTIES in writing.
Owner Personnel. Upon request by the Owner, the Construction Manager shall provide suitable office space and facilities for the representatives imbedded by the Owner pursuant to Section 4.6(a). In addition, the Construction Manager shall provide suitable office space and facilities for (i) the personnel provided by the Owner pursuant to Section 4.6(b) no later than the date on which such personnel are to arrive at the Site, and (ii) the Owner personnel described in Section 4.7 no later than the date that is three (3) months before the expected date of the commencement of operations of the Selexol Unit.
Owner Personnel. (a) During the Term (and for long as the applicable Seconded Employee (as defined below) remains employed by Owner), Owner shall, pursuant to the terms of this Agreement, second to Operator the Seconded Employees to operate and conduct the Business. Operator will operate the Business with the Seconded Employees and such other employees, consultants, agents and representatives as Operator may determine in its sole discretion. The services provided to Operator by the Seconded Employees pursuant to this Agreement are referred to herein as the “Services.” Subject to Owner’s right to be reimbursed by Operator for costs and expenses in accordance with Sections 6(h) and 6(i), Owner shall be responsible for payment of, and shall satisfy all obligations with respect to, all costs and expenses required in connection with the employment of the Seconded Employees, including salaries, wages, other cash compensation, employee benefits and overhead and administrative expenses, the reporting and payment of social security and other payroll taxes, workers’ compensation insurance premiums and all other applicable costs and expenses. Owner shall have the right to determine the terms and conditions on which it employs the Seconded Employees including the compensation and benefits to which the Seconded Employees may be eligible; provided, however, that such terms and conditions of employment shall be consistent with Owner’s past employment practices and the terms of Section 5.01 of the Cosi APA, and any changes to compensation or benefits shall be subject to the prior written approval of Operator.
(b) Each Business Employee listed on Schedule 4 shall, during the period of time that such individual is seconded to Operator under this Agreement (the “Period of Secondment”), be referred to individually herein as a “Seconded Employee” and, collectively, as the “Seconded Employees.” Each Seconded Employee shall devote all of his or her working time to the performance of the Services during such Seconded Employee’s Period of Secondment. Operator may, in its discretion, provide to each Seconded Employee notices or other information regarding such Seconded Employee’s secondment and the terms of such secondment.
(c) Operator has the right to terminate the secondment to it of any Seconded Employee for any reason at any time upon not less than three (3) Business Days prior written notice to Owner. Upon the termination of the secondment of any Seconded Employee (whether as a result of term...

(b) The Construction Manager shall provide at least four (4) months written notice to the Owner of the expected date of the commencement of operations on the Selexol Unit.
Owner Personnel. The Owner, in its sole discretion and at its expense, may provide one or more professional personnel to work in the Utility Plant and also to be on Site during the Transition Phase. The Owner intends to assign the Owner’s Representative to the Utility Plant and/or Site for the purposes of observing the performance of the Services and compliance with this Agreement. The intention is not to have the Owner’s Representative perform any of the Services. However, to the extent that any of Owner’s personnel provide Services at the request of the Operator, such personnel will be under the direction of the Operator and the Operator will continue to be solely responsible for the provision of the Services.
