Termination by PSI 8. 2 Ukončení ze strany PSI (i) if the Institution and/or the Investigator breaches this Agreement and fails to cure such breach within thirty (30) calendar days from the receipt of written notice; (ii) if PSI or the Sponsor in good faith believe the Study Drug or continuation of the Study presents an unreasonable medical risk to the Study subjects or if there are efficacy or safety concerns; (iii) if the Study is suspended or not initiated at the Institution for any reason; or (iv) if the agreement between the Sponsor and PSI regarding the Study is terminated. Zdravotnické zařízení a/nebo Hlavní zkoušející poruší tuto Smlouvu a nezjedná nápravu do třiceti (30) kalendářních dnů od obdržení písemného upozornění, (ii) pokud se PSI nebo Zadavatel budou v dobré víře domnívat, že Studijní lék nebo pokračování ve Studii představuje nepřiměřené zdravotní riziko pro Subjekty hodnocení, nebo pokud budou mít obavy ohledně účinnosti či bezpečnosti Studijního léku, (iii) pokud bude Studie z jakéhokoli důvodu ve Zdravotnickém zařízení přerušena, nebo nebude zahájena, nebo (iv) pokud dojde k ukončení Smlouvy týkající se Studie uzavřené mezi PSI a Zadavatelem.

Termination by PSI 8. 2 Ukončenie zo strany PSI a) Throughout the course of this Agreement, PSI, reserves the right to terminate the Agreement for the following reasons: (i) if the Institution breaches any of its obligations under this Agreement, (ii) if the Investigational Medicinal Product or continuation of the Study presents an unreasonable medical risk to the Study Subjects; or if there are efficacy concerns, (iii) if the Study is terminated or suspended. The termination shall become effective on the day of delivery of the notice of termination of this Agreement to the Institution; in case of uncertainty the Contracting Parties have agreed that the termination will be considered effective on the third day following the day on which the notice was properly sent by post to the address of the Institution’s registered office with day of sending not being included in this period. b) PSI may terminate this Agreement without giving reasons with a notice period of thirty (30) calendar days; notice period starts from the first day of the month following delivery of notice to the Institution. a/ Počas platnosti tejto Zmluvy si PSI vyhradzuje právo odstúpiť od zmluvy z následovných dôvodov : (ii) v prípade porušenia akýchkoľvek záväzkov zo strany Inštitúcie vyplývajúcich z tejto Zmluvy; (iii) ak by Skúšaný liek alebo pokračovanie Štúdie predstavovali pre Účastníkov štúdie neprimerané riziko, alebo v prípade pochybností o účinnosti lieku; (iv) ak bude Štúdia zastavená alebo prerušená. Odstúpenie nadobúda účinnosť dňom doručenia písomného oznámenia o odstúpení od zmluvy Institúcií; v prípade pochybnosti sa zmluvné strany dohodli, že odstúpenie budú považovať za doručené na tretí deň odo dňa jeho riadneho odoslania poštou na adresu sídla Inštitúcie, pričom den odoslania sa do tejto lehoty nepočíta. b/ PSI je oprávnené tuto zmluvu vypovedať a to bez uvedenia dôvodov s výpovednou lehotou tridsať (30) kalendárnych dní; výpovedná lehota začne plynúť od prvého dňa mesiaca nasledujúceho po doručení výpovede Inštitúcii.

Termination by PSI 8. 2 Ukončení ze strany PSI (i) if the Provider and/or the Investigator breaches this Agreement and fails to cure such breach within thirty (30) calendar days from the receipt of written notice; (ii) if PSI or the Sponsor in good faith believe the Study Drug or continuation of the Study presents an unreasonable medical risk to the Study subjects or if there are efficacy or safety concerns; (iii) if the Study is suspended or not initiated at the PSI smí po dohodě se Zadavatelem ukončit tuto ▇▇▇▇▇▇▇ s okamžitou platností, (i) pokud Poskytovatel a/nebo Hlavní zkoušející poruší tuto Smlouvu a nezjedná nápravu do třiceti (30) kalendářních dnů od obdržení písemného upozornění, (ii) pokud se PSI nebo Zadavatel budou v dobré víře domnívat, že Studijní lék nebo pokračování ve Studii představuje nepřiměřené zdravotní riziko pro Subjekty hodnocení, nebo pokud budou mít obavy ohledně účinnosti či bezpečnosti Studijního léku, (iii) pokud bude Provider for any reason; or (iv) if the agreement between the Sponsor and PSI regarding the Study is terminated. In case of such termination, PSI shall pay the Provider and Investigator for the activities performed up to the date of termination and the Sponsor shall have the right to receive from the Provider and the Investigator the results of the activities completed up to the termination date, which results shall be subjected to the regulations of Section 3 (Confidentiality) and Section 4 (Intellectual Property). Without prejudice to the foregoing, it is understood that no compensation, indemnification or whatever else shall be due by PSI or the Sponsor to the Provider and/or Investigator as a consequence of the early termination provided herein.
