Common use of Termination for Concessioning Authority Event of Default Clause in Contracts

Termination for Concessioning Authority Event of Default. i. Without prejudice to any other right or remedy which the Concessionaire may have in respect thereof under this Agreement, upon the occurrence of Concessioning Authority Event of Default, the Concessionaire shall be entitled to terminate the Agreement by issuing Termination Notice. ii. If the Concessionaire decides to terminate the Agreement pursuant to preceding the above Clause (i), it shall in the first instance issue Preliminary Notice to Remedy to the Concessioning Authority. Within 30 (Thirty) days of receipt of Preliminary Notice to Remedy, to Concessioning Authority shall forward to the Concessionaire its proposal to remedy / cure the underlying Event of Default (the "Concessioning Authority Proposal to Rectify”). In case of non-submission of Concessioning Authority Proposal to Rectify within the said period of 30 (Thirty) days, Concessionaire shall be entitled to terminate the Agreement by issuing Termination Notice. iii. If Concessioning Authority Proposal to Rectify is forwarded to the Concessionaire within the period stipulated thereof, Concessioning Authority shall have further period of 90 (Ninety) days to remedy / cure the underlying Event of Default. If, however Concessioning Authority fails to remedy / cure the underlying Event of Default within such further period allowed, the Concessionaire shall be entitled to terminate the Agreement by issuing Termination Notice.

If, however Concessioning Authority fails to remedy / cure the underlying Event of Default within such further period p eriod allowed, the Concessionaire shall be entitled to terminate the this Agreement by issuing Termination Notice.

If, however Concessioning Authority fails to remedy / cure the underlying Event of Default within such further period allowed, the Concessionaire Co ncessionaire shall be entitled to terminate the this Agreement by issuing Termination Notice.

If Concessioning Authority Proposal to Rectify is forwarded to the Concessionaire within the period stipulated thereof, Concessioning Authority shall have further period of 90 (Ninety) days to remedy / cure the underlying Event of Default. If, however Concessioning Authority Autho rity fails to remedy / cure the underlying Event of Default within such further period allowed, the Concessionaire shall be entitled to terminate the Agreement by issuing Termination Notice.
