Common use of Termination for Extended off-Hire Clause in Contracts

Termination for Extended off-Hire. (a) In the event that the Vessel is off-Hire for any reason other than in connection with Scheduled Drydocking for any period in excess of ***** or exceeding ***** in any period of *****, Customer shall have the option to exercise its rights pursuant to Clause 22.3, provided that if Customer elects to terminate this Agreement, such termination shall not be effective until the Vessel is free of cargo (other than LNG Heel). This Clause 14.5 is without prejudice to any other rights or obligations of Contractor or Customer under this Agreement. For the purposes of this Clause 14.5, in the event of partial loss of service, the period of off-Hire shall be the total period during which the Vessel is not fully efficient rather than the resulting loss of time.

This Clause 14.5 18.3 is without prejudice to any other rights or obligations of Contractor Owner or Customer Charterer under this AgreementCharter. For the purposes of this Clause 14.518.3, in the event of partial loss of service, the period of off-Hire shall be the total period during which the Vessel is not fully efficient rather than the resulting loss of time.
