Common use of Termination for Insolvency or Breach Clause in Contracts

Termination for Insolvency or Breach. If: an Insolvency Event occurs to the Consultant or, where the Consultant comprises 2 or more persons, to any one of those persons; the Consultant does not remedy a breach of Contract the subject of a notice under clause 11.3 within the number of days set out in the Contract Particulars of receiving the notice under clause 11.3; or the Consultant fails to comply with: clause 15; or if clause 16 applies, clause 16, then the Commonwealth may by written notice to the Consultant immediately (and without having to first give a notice under clause 11.3 (except in the case of paragraph (b)) terminate the Contract.

If: an Insolvency Event occurs to the Consultant or, where the Consultant comprises 2 or more persons, to any one of those persons; the Consultant does not remedy a breach of Contract the subject of a notice under clause 11.3 30.3 within the number of days set out in the Contract Particulars of receiving the notice under clause 11.330.3; or the Consultant fails to comply with: clause 1534; or if clause 16 35 applies, clause 1635, then the Commonwealth may by written notice to the Consultant immediately (and without having to first give a notice under clause 11.3 30.3 (except in the case of paragraph (b)) terminate the Contract.

If: an Insolvency Event occurs to the Consultant or, where the Consultant comprises 2 or more persons, to any one of those persons; the Consultant does not remedy a breach of Contract Subcontract the subject of a notice under clause 11.3 within the number of days set out in the Contract Subcontract Particulars of receiving the notice under clause 11.3; or the Consultant fails to comply with: clause 15; or if clause 16 applies, clause 16, then the Commonwealth Contractor may by written notice to the Consultant immediately (and without having to first give a notice under clause 11.3 (except in the case of paragraph (b)) terminate the ContractSubcontract.

If: an Insolvency Event occurs to the Consultant or, where the Consultant comprises 2 two or more persons, to any one of those persons; the Consultant does not remedy a failure or breach of Contract the subject of a notice under clause 11.3 12.3 within the number of days set out specified in the Contract Particulars of receiving the notice under clause 11.312.3; or the Consultant fails to comply with: clause 1516.; or if clause 16 17. applies, clause 1617.; or clause 18., then the Commonwealth may by written notice to the Consultant immediately (and without having to first give a notice under clause 11.3 12.3 (except in the case of paragraph (b))) terminate the Contract.
