Common use of Termination for Non Clause in Contracts

Termination for Non. Compliance with Public Contracts Regulations 2015 (“the Regulations”) in accordance with Section 73(1) of the Regulation. 45.5.1. The Council shall forthwith by notice in writing terminate the Contract where: i. the Contract has been subject to a substantive modification which would have required a new procurement procedure in accordance with Regulation 72 (9). ii. the Provider should not have been selected or awarded the Contract because: the Provider was at the time of such selection or award or following such selection or award is convicted of any of the offences in Regulation 57 (1) of the Regulations. the Provider is in breach of its obligations relating to the payment of taxes or social security contributions. iii. the Council has to terminate the Contract: a. as a requirement of the Regulations or b to comply with the Regulations or c. on the order of a competent Court or Regulatory Authority. 45.5.2. The Council may by notice in writing terminate the Contract where: the Provider’s tender did not comply with applicable obligations in the fields of current environmental, social and labour law in accordance with Regulation 56(2) of the Regulations;
