Terms of Participation in WhiteWave Welfare Plans. WhiteWave shall cause the WhiteWave Welfare Plans to (i) waive all limitations as to preexisting conditions, exclusions, service conditions and waiting period limitations, and any evidence of insurability requirements applicable to any such WhiteWave Employees other than such limitations, exclusions, and conditions that were in effect with respect to WhiteWave Employees as of the Distribution Date, in each case under the corresponding Xxxx Foods Welfare Plan and (ii) honor any deductibles, out-of-pocket maximums and co-payments incurred by WhiteWave Employees under the corresponding Xxxx Foods Welfare Plan in satisfying the applicable deductibles, out-of-pocket expenses or co-payments under such Xxxx Foods Welfare Plan for the calendar year in which the Distribution Date occurs.
