TESTING OF THE BCDR PLAN. The Service Provider shall test the BCDR Plan on a regular basis (and in any event not less than once in every Contract Year). Subject to paragraph 6.2, the Purchaser may require the Service Provider to conduct additional tests of some or all aspects of the BCDR Plan at any time where the Purchaser considers it necessary, including where there has been any change to the Services or any underlying business processes, or on the occurrence of any event which may increase the likelihood of the need to implement the BCDR Plan. If the Purchaser requires an additional test of the BCDR Plan, it shall give the Service Provider written notice and the Service Provider shall conduct the test in accordance with the Purchaser's requirements and the relevant provisions of the BCDR Plan. The Service Provider shall undertake and manage testing of the BCDR Plan in full consultation with the Purchaser and shall liaise with the Purchaser in respect of the planning, performance, and review, of each test, and shall comply with the reasonable requirements of the Purchaser in this regard. Each test shall be carried out under the supervision of the Purchaser or its nominee. The Service Provider shall ensure that any use by it or any Sub-contractor of “live” data in such testing is first approved with the Purchaser. Copies of live test data used in any such testing shall be (if so required by the Purchaser) destroyed or returned to the Purchaser on completion of the test. The Service Provider shall, within twenty (20) Working Days of the conclusion of each test, provide to the Purchaser a report setting out: the outcome of the test; any failures in the BCDR Plan (including the BCDR Plan's procedures) revealed by the test; and the Service Provider's proposals for remedying any such failures. Following each test, the Service Provider shall take all measures requested by the Purchaser, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the Service Provider, at no additional cost to the Purchaser, by the date reasonably required by the Purchaser and set out in such notice. For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s procedures) shall not relieve the Service Provider of any of its obligations under this Contract. The Service Provider shall also perform a test of the BCDR Plan in the event of any major reconfiguration of the Services or as otherwise reasonably requested by the Purchaser.

The Service Provider Supplier shall undertake and manage testing of the BCDR Plan in full consultation with the Purchaser Customer and shall liaise with the Purchaser Customer in respect of the planning, performance, and review, of each test, and shall comply with the reasonable requirements of the Purchaser Customer in this regard. Each test shall be carried out under the supervision of the Purchaser Customer or its nominee. The Service Provider Supplier shall ensure that any use by it or any Sub-contractor Contractor of “live” data in such testing is first approved with the PurchaserCustomer. Copies of live test data used in any such testing shall be (if so required by the PurchaserCustomer) destroyed or returned to the Purchaser Customer on completion of the test. The Service Provider Supplier shall, within twenty (20) Working Days of the conclusion of each test, provide to the Purchaser Customer a report setting out: the outcome of the test; any failures in the BCDR Plan (including the BCDR Plan's procedures) revealed by the test; and the Service Provider's Suppliers proposals for remedying any such failures. Following each test, the Service Provider Supplier shall take all measures requested by the PurchaserCustomer, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the Service ProviderSupplier, at no additional cost to the PurchaserCustomer, by the date reasonably required by the Purchaser Customer and set out in such notice. For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s procedures) shall not relieve the Service Provider Supplier of any of its obligations under this Contract. The Service Provider Supplier shall also perform a test of the BCDR Plan in the event of any major reconfiguration of the Goods and/or Services or as otherwise reasonably requested by the PurchaserCustomer.

If the Purchaser Customer requires an additional test of the BCDR Plan, Plan it shall give the Service Provider Supplier written notice and the Service Provider Supplier shall conduct the test in accordance with the PurchaserCustomer's requirements and the relevant provisions of the BCDR Plan. The Service ProviderSupplier's costs of the additional test shall be borne by the Purchaser Customer unless the BCDR Plan fails the additional test in which case the Service ProviderSupplier's costs of that failed test shall be borne by the Service ProviderSupplier. Following each test, the Supplier shall send to the Customer a written report summarising the results of the test and shall promptly implement any actions or remedial measures which the Customer considers to be necessary as a result of those tests. The Service Provider Supplier shall also perform a test of the BCDR Plan in the event of any major reconfiguration as part of the Services or as otherwise reasonably requested by commissioning of the PurchaserServices.

The Service ProviderSupplier's costs of the additional test shall be borne by the Purchaser Contracting Authority unless the BCDR Plan fails the additional test in which case the Service ProviderSupplier's costs of that failed test shall be borne by the Service ProviderSupplier. Schedule 2: Business Continuity and Disaster Recovery Telephony Services 7.6 The Service Provider Supplier shall, within twenty (20) Working Days of the conclusion of each test, provide to the Purchaser Contracting Body a report setting out: : 7.6.1 the outcome of the test; ; 7.6.2 any failures in the BCDR Plan (including the BCDR Plan's procedures) revealed by the test; and and 7.6.3 the Service ProviderSupplier's proposals for remedying any such failures. . 7.7 Following each test, the Service Provider Supplier shall take all measures requested by the PurchaserContracting Body, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the Service ProviderSupplier, at no additional cost to the PurchaserContracting Body, by the date reasonably required by the Purchaser Contracting Body and set out in such notice. . 7.8 For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s 's procedures) shall not relieve the Service Provider Supplier of any of its obligations under this Contract. Schedule 2 or otherwise. 7.9 The Service Provider Supplier shall also perform a test of the BCDR Plan in the event of any major reconfiguration as part of the Services or as otherwise reasonably requested by commissioning of the PurchaserServices.

The Service ProviderCONTRACTOR's costs of the additional test shall be borne by the Purchaser CUSTOMER unless the BCDR Plan fails the additional test in which case the Service ProviderCONTRACTOR's costs of that failed test shall be borne by the Service Provider. The Service Provider Supplier shall ensure that any use by it or any Sub-contractor Contractor of “live” data in such testing is first approved with Approved by the PurchaserAuthority. Copies of live test data used in any such testing shall be (if so required by the PurchaserAuthority) destroyed or returned to the Purchaser Authority on completion of the test. The Service Provider Supplier shall, within twenty (20) Working Days of the conclusion of each test, provide to the Purchaser Authority a report setting out: the outcome of the test; any failures in the BCDR Plan (including the BCDR Plan's procedures) revealed by the test; and the Service ProviderSupplier's proposals for remedying any such failures. Following each test, the Service Provider Supplier shall take all measures requested by the PurchaserAuthority, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the Service ProviderSupplier, at no additional cost to the PurchaserAuthority, by the date reasonably required by the Purchaser Authority and set out in such notice. For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s procedures) shall not relieve the Service Provider Supplier of any of its obligations under this Contract. The Service Provider Supplier shall also perform a test of the BCDR Plan in the event of any major reconfiguration of the Services or as otherwise reasonably requested by the PurchaserAuthority.

The Service ProviderSupplier's costs of the additional test shall be borne by the Purchaser Customer unless the BCDR Plan fails the additional test in which case the Service ProviderSupplier's costs of that failed test shall be borne by the Service ProviderSupplier. Following each test, the Supplier shall send to the Customer a written report summarising the results of the test and shall promptly implement any actions or remedial measures which the Customer considers to be necessary as a result of those tests. For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s procedures) shall not relieve the Service Provider Supplier of any of its obligations under this Call Off Contract. The Service Provider Supplier shall also perform a test of the BCDR Plan in the event of any major reconfiguration of the Services or as otherwise reasonably requested by the PurchaserCustomer.

The Service ProviderContractor's costs of the additional test shall be borne by the Purchaser Authority unless the BCDR Plan fails the additional test in which case the Service ProviderContractor's costs of that failed test shall be borne by the Service ProviderContractor. Following each test, the Contractor shall send to the Authority a written report summarising the results of the test and shall promptly implement any actions or remedial measures which the Authority considers to be necessary as a result of those tests. Following each test, the Service Provider Contractor shall take all measures requested by the PurchaserAuthority, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the Service ProviderContractor, at no additional cost to the PurchaserAuthority, by the date reasonably required by the Purchaser Authority and set out in such notice. Following each test, the Supplier shall send to the Customer a written report summarising the results of the test and shall promptly implement any actions or remedial measures which the Customer considers to be necessary as a result of those tests. 7.4. The Service Provider Supplier shall undertake and manage testing of the BCDR Plan in full consultation with the Purchaser Customer and shall liaise with the Purchaser Customer in respect of the planning, performance, and review, of each test, and shall comply with the reasonable requirements of the Purchaser Customer in this regard. Each Where required by the Customer, each test shall be carried out under the supervision of the Purchaser Customer or its nominee. 7.5. Following each test, the Service Provider Supplier shall take all measures requested by the PurchaserCustomer, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the Service ProviderSupplier, at no additional cost to the PurchaserCustomer, by the date reasonably required by the Purchaser Customer and set out in such notice. 7.8. For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s Plan‟s procedures) shall not relieve the Service Provider Supplier of any of its obligations under this ContractSchedule 3 or otherwise. 7.9. The Service ProviderSupplier's costs of the additional test shall be borne by the Purchaser Customer unless the BCDR Plan fails the additional test in which case the Service ProviderSupplier's costs of that failed test shall be borne by the Service ProviderSupplier. The Service Provider Supplier shall undertake and manage testing of the BCDR Plan in full consultation with the Purchaser Customer and shall liaise with the Purchaser Customer in respect of the planning, performance, and review, of each test, and shall comply with the reasonable requirements of the Purchaser Customer in this regard. Each test shall be carried out under the supervision of the Purchaser Customer or its nominee. The Service Provider Supplier shall ensure that any use by it or any Sub-contractor Contractor of “live” data in such testing is first approved with the PurchaserCustomer. Copies of live test data used in any such testing shall be (if so required by the PurchaserCustomer) destroyed or returned to the Purchaser Customer on completion of the test. The Service Provider Supplier shall, within twenty (20) Working Days of the conclusion of each test, provide to the Purchaser Customer a report setting out: the outcome of the test; any failures in the BCDR Plan (including the BCDR Plan's procedures) revealed by the test; and the Service ProviderSupplier's proposals for remedying any such failures. Following each test, the Service Provider Supplier shall take all measures requested by the PurchaserCustomer, (including requests for the re-testing of the BCDR Plan) to remedy any failures in the BCDR Plan and such remedial activity and re-testing shall be completed by the Service ProviderSupplier, at no additional cost to the PurchaserCustomer, by the date reasonably required by the Purchaser Customer and set out in such notice. For the avoidance of doubt, the carrying out of a test of the BCDR Plan (including a test of the BCDR Plan’s procedures) shall not relieve the Service Provider Supplier of any of its obligations under this Call Off Contract. The Service Provider Supplier shall also perform a test of the BCDR Plan in the event of any major reconfiguration of the Products and/or Services or as otherwise reasonably requested by the PurchaserCustomer.

If the Purchaser Customer requires an additional test of the BCDR Plan, it shall give the Service Provider Supplier written notice and the Service Provider Supplier shall conduct the test in accordance with the Purchaser's Customer’s requirements and the relevant provisions of the BCDR Plan. The Service Provider's Suppliers costs of the additional test shall be borne by the Purchaser Customer unless the BCDR Plan fails the additional test in which case the Service Provider's Suppliers costs of that failed test shall be borne by the Service ProviderSupplier. The Service ProviderSupplier's costs of the additional test shall be borne by the Purchaser Customer unless the BCDR Plan fails the additional test in which case the Service ProviderSupplier's costs of that failed test shall be borne by the Service ProviderSupplier. Following each test, the Supplier shall send to the Customer a written report summarising the results of the test and shall promptly implement any actions or remedial measures which the Customer considers to be necessary as a result of those tests. The Service Provider Supplier shall undertake and manage testing of the BCDR Plan in full consultation with the Purchaser Customer and shall liaise with the Purchaser Customer in respect of the planning, performance, and review, of each test, and shall comply with the reasonable requirements of the Purchaser Customer in this regard. Each Where required by the Customer, each test shall be carried out under the supervision of the Purchaser Customer or its nominee. The Service Provider Supplier shall also perform a test of the BCDR Plan in the event of any major reconfiguration as part of the Services or as otherwise reasonably requested by commissioning of the PurchaserGoods and Services.
