The Actual Deferral Percentage for any Participant who is a Highly Compensated Employee for the Plan Year and who is eligible to have Salary Deferral Contributions (and Qualified Nonelective Contributions and/or Qualified Matching Contributions, if treated as Salary Deferral Contributions for purposes of this section) allocated to his or her Accounts under two or more 401(k) arrangements that are maintained by any Employer or Related Employer will be determined as if all such contributions were made under a single arrangement. If a Highly Compensated Employee participates in two or more 401(k) arrangements that have different plan years, all 401(k) arrangements with plan years ending within the same calendar year will be treated as a single arrangement.
