Common use of The Resident Clause in Contracts

The Resident. a. Does not meet the residency requirements established by the state b. Presents an imminent physical threat or danger to self or others; c. Requires more than intermittent skilled nursing care or the skilled nursing care provided by the FACILITY. To be considered intermittent, the skilled care may be rendered for not more than eight hours a day or 40 hours per week. Intermittent nursing services may not be delivered for more than a total of 120 days in any twelve-month period regardless of any transfer or discharge from the FACILITY; d. Fails to pay fees and charges when due, or breaches any representation, covenant, agreement, or obligation of the Resident under this Agreement; e. Fails to accept additional services when it is in the best interest of the Resident to have these services provided to him/her; f. Has health care needs that cannot be met in the FACILITY, for reasons such as licensure, design or staffing, as determined by the FACILITY; g. Fails to comply with the FACILITY Guidelines; h. Is habitually disruptive, creates unsafe conditions, or is physically or verbally abusive to other residents or staff; or
