Common use of THE WORKS Clause in Contracts

THE WORKS. 3.1 The Builder undertakes to execute the Works which will on finalization constitute the Residential House, in a proper and workmanlike manner against payment of the Construction cost as defined and referred to in Clause 4 of the Schedule of Particulars. Initial here 3.2 The Works shall be substantially in accordance with the House Plan and the Standard Specifications attached hereto, respectively marked, Annexure B and Annexure C, provided that the Builder shall be entitled in his discretion to deviate from the House Plan and Standard Specifications if, during the planning, building and construction of the Works if such deviation will result in the most practical and economical completion of the Works without materially deviating from the House Plan or Standard Specifications or having a negative effect on the quality and finishing of the Works. The Builder may do so without the consent of the Purchaser(s). 3.3 In the event of any discrepancy arising from the House Plan and the Standard Specifications, the provisions of the House Plan shall prevail. 3.4 The placement of the building on the erf shall be as per the recommendation of the Architect, whose decision will be final and binding on all Parties. 3.5 Any alterations to the House Plan or Standard Specifications by the Purchaser(s) will be at the discretion of the Builder. Any amendments or alterations which are accepted by the Builder will be for the account of the Purchaser(s).
