Third Party Product. Except as expressly stated otherwise in this Agreement or related documents: (i) Hitachi provides Third Party Products to You without warranties or support of any kind, and (ii) licenses, warranties, indemnities as applicable and support for these Third Party Products will be given by the relevant suppliers in their agreements and support terms that Hitachi passes on to You or that You otherwise enter with such suppliers.
Third Party Product. Third Party Product (as defined in this Section 12.3) may carry a limited warranty from a limited warranty from the third-party publisher, provider, or original manufacturer of such Third Party Products. To the extent required or allowed, Arctic Wolf will pass through to Customer or directly manage for the benefit of Customer’s use of the Third Party Products as part of the Solutions (such decision to be made in Arctic Wolf’s discretion), the manufacturer warranties related to such Third Party Products. “Third Party Product” means any non- Arctic Wolf branded products and services (including Equipment, and any operating system software included therewith) and non-Arctic Wolf- licensed software products, including Open Source Software.
Third Party Product. Third-Party Product (as defined in this Section 10.4) may carry a limited warranty from the third-party publisher, provider, or original manufacturer of such Third-Party Products. To the extent required or allowed, Arctic Wolf will pass through to Customer or

A Third Party Product is (a) a Software Product the copy- right to which clearly belongs to a company other than the Supplier or a company within the Supplier's group of companies, and nothing else follows from the Agre- ement, or (b) Maintenance Objects specified as Third Party Products in accordance with the Agreement.

If Amyris engages in research and development activities with its business partner or any other Person and if such Person does not have exclusivity as to the product developed through such activities, then the Company shall have the right to sell, distribute or otherwise deal with such product in the Field.

Third Party Product. Where We supply Third Party Products to be used in conjunction with Our Software the following additional terms apply:
4.7.1 You shall indemnify Us in respect of any Demands suffered or incurred by Us, directly or indirectly, arising from or in connection with any breach by You any applicable Third Party XXXX.
4.7.2 We may treat any breach by You of the Third Party XXXX as a breach of the Agreement.
4.7.3 Unless otherwise agreed by Us or specified in the Agreement or as may be permitted by the relevant third party supplier or licensor (a) You may only use Third Party Product supplied by Us (whether as a stand alone product or comprised in and forming part of the Software) in conjunction with use of Our Software; and (b) Your right to use or receive such Third Party Product shall cease if the relevant licence or right terminates or expires in accordance with the relevant Third Party XXXX or other third party licence terms and shall otherwise cease on termination of the Agreement or Software Licence and Support Attachment.
4.7.4 Where Our right to supply or make available, arrange and/or procure Third Party Product ceases for any reason We reserve the right to withdraw and terminate the provision of the Third Party Product and all related facilities and services under the Agreement and Software Licence and Support Attachment immediately on notice to You provided We shall use commercially reasonable efforts to provide You with as much notice as is reasonably practicable and shall use commercially reasonable efforts to offer replacement or substitute Third Party Product.
4.7.5 We reserve the right to change, replace or substitute any Third Party Product. Where such change, replacement or substitute shall adversely affect the ongoing cost, functionality or quality (as the case may be) of the solution provided by such Third Party Product, We shall obtain Your prior written consent (such consent not to be unreasonably withheld) to such change, replacement or substitute.
4.7.6 We reserve the right to suspend or terminate Your use or access to a Third Party Product pursuant to the Agreement immediately on notice if: (a) You breach the terms of the relevant Third Party XXXX or other third party licence terms; (b) You breach any term of the Agreement relating to the Third Party Products; or (c) if We are lawfully required or requested to do so by the relevant third party licensor or supplier.
Third Party Product. If the Agreement includes the sale of third-party product not manufactured by Draeger or any of its affiliates, such products are provided to Customer solely at the direction of Customer with no recommendation by Draeger. Except as expressly provided otherwise in the Agreement, Draeger makes no warranty for any third- party product. Customer’s sole warranty for any third-party product, if any, is the original manufacturer’s warranty, which Draeger agrees to pass on to Customer, as applicable. The obligation of Customer to pay Draeger for the third-party product is absolute and unconditional, and Customer waives and releases Draeger from all claims, damages, and losses arising out of such third-party product regardless of any claims Customer may have regarding such third-party product.
