This Special Stipulation pertains to Tract 1 only. The sale of this property is also subject to that certain Mutual Grant of Easement for a driveway recorded in Deed Book 8-P, Page 123, Public Deed Records of Terrell County, Georgia, (a copy of said easement can be provided by Weeks Auction). The successful bidder will also have the option of entering into an easement with the adjoining landowner, Xxxxxx X. Xxxxxx, to continue the use of an easement for an irrigation pipe which services the Subject Property as well as that owned by Xx. Xxxxxx. If the successful bidder wishes to acquire the legal rights associated with said easement (a pro forma copy of said easement can be provided by Weeks Auction), he/she shall also be required to enter into a lease with Xx. Xxxxxx. (a pro forma copy of said lease can be provided by Weeks Auction). Should the successful bidder wish to exercise his/her rights to be the recipient of the irrigation pipe easement and associated lease with Xx. Xxxxxx, he/she shall also be entitled to the Right of First Refusal (a pro forma copy of said easement to be provided by Weeks Auction) to purchase the Xxxxxx X. Xxxxxx property.

  • Definitions Specific to Special Terms The words and phrases listed below, as used in this Contract, shall each have the following definitions:

  • Certificate of Completion The Interconnection Customer shall provide the EDC with a completed copy of the Interconnection Agreement Certificate of Completion, including evidence of the electrical inspection performed by the local authority having jurisdiction. The evidence of completion of the electrical inspection may be provided on inspection forms used by local inspecting authorities. The Interconnection request shall not be finally approved until the EDC’s representative signs the Interconnection Agreement Certificate of Completion.

  • Vendor’s Specific Warranties, Terms, and License Agreements Because TIPS serves public entities and non-profits throughout the nation all of which are subject to specific laws and policies of their jurisdiction, as a matter of standard practice, TIPS does not typically accept a Vendor’s specific “Sale Terms” (warranties, license agreements, master agreements, terms and conditions, etc.) on behalf of all TIPS Members. TIPS may permit Vendor to attach those to this Agreement to display to interested customers what terms may apply to their Supplemental Agreement with Vendor (if submitted by Vendor for that purpose). However, unless this term of the Agreement is negotiated and modified to state otherwise, those specific Sale Terms are not accepted by TIPS on behalf of all TIPS Members and each Member may choose whether to accept, negotiate, or reject those specific Sale Terms, which must be reflected in a separate agreement between Vendor and the Member in order to be effective.

  • Execution of Change Orders Change Orders shall be signed by the Contractor, ordinarily certified by the Design Professional, and approved by the Owner in accordance with the form of Change Order prescribed by the Owner. No request for payment by the Contractor for a Change Order shall be due, nor shall any such request appear on an Application for Payment, until the Change Order is executed by the Owner. In the event of emergency (see Article 1.4.4) or significant impact to the Overall Project Schedule, the Owner shall direct the Change Order to proceed upon a Force Account until the cost and time is resolved in the manner set forth in Paragraph 3.2.7.3 below.

  • Final Certificate, Design Professional’s Certificate of Final Completion The Certificate issued by the Design Professional stating that all work has been completed in accordance with the terms of the Contract Documents. See Section 6,

  • CLARIFICATION OF SPECIFICATION DOCUMENTS 4.1 Bidders shall promptly notify the Purchasing Agent of any ambiguity, inconsistency or error which they may discover upon examination of the specification documents.

  • Certificate of Substantial Completion The Date of Substantial Completion of the Work or designated portion thereof is the Date certified by the City when construction is sufficiently complete, in accordance with the Contract Documents, so the City of Roanoke, Virginia (City or Owner) can occupy or utilize the Work or designated portion thereof for the use for which it is intended, as expressed in the Contract Documents.
