Ticket Vending System. In the event that SFRTA secures a new ticket vending system to replace its current ticket vending system that is in place as of the date of this Agreement, SFRTA will use all commercially reasonable efforts to configure such new ticket vending system so that commuters can jointly purchase both SFRTA and AAF tickets with it being understood that SFRTA and AAF will develop a system for revenue distribution. Notwithstanding the foregoing, SFRTA and AAF acknowledge and agree that any such arrangement will be structured in such a way as to avoid any determination by the STB that SFRTA or AAF has become a rail carrier providing transportation subject to the jurisdiction of the STB by virtue of its participation in any such arrangement.
