The 'Time for Referral' clause establishes a specific timeframe within which a dispute or issue must be formally referred to a designated authority or process, such as arbitration or mediation. Typically, this clause outlines the number of days or months after an event or failed negotiation during which a party must initiate the referral process. By setting clear deadlines, the clause ensures that disputes are addressed promptly and prevents parties from delaying resolution indefinitely, thereby promoting efficiency and certainty in the dispute resolution process.
Time for Referral. If any Union’s registration and referral system does not fulfill the requirements for specific classifications requested by any Contractor within forty-eight (48) hours (excluding Saturdays, Sundays and holidays), that Contractor may use employment sources other than the Union registration and referral services, and may employ applicants meeting such standards from any other available source. The Contractors shall inform the Union of any applicants hired from other sources within forty-eight (48) hours of such applicant being hired, and such applicants shall register with the appropriate hiring hall, if any.

The Contractor should promptly inform the Union of any applicants hired from other sources, and such applicants shall register with the appropriate hiring hall, if any.

If any Union’s registration and referral system does not fulfill the requirements for specific classifications requested by any Contractor (including requests for Targeted Workers) within forty-eight (48) hours (excluding Saturdays, Sundays and holidays), that Contractor may use employment sources other than the Union registration and referral services, and may employ applicants meeting such standards from any other available source. The Contractors shall inform the Union of any applicants hired from other sources within forty-eight (48) hours of such applicant being hired, and such applicants shall register with the appropriate hiring hall, on or before the th eighth (8 ) day of consecutive or cumulative employment.

If any Union’s registration and referral system does not fulfill the requirements for specific classifications of covered employees requested by an MTS Contractor within forty-eight (48) hours (excluding Saturdays, Sundays, and holidays), that Contractor may use any number of its Core Employees without seeking referrals from the Union hiring hall for that classification of workers, or it may use employment sources other than the Union registration and referral services, and may employ applicants from any other available source. The Union may not subsequently require a MTS Contractor to replace these applicants with referrals from a Union’s hiring hall after the forty-eight (48) hours (excluding Saturdays, Sundays, and holidays) time period has expired. The Contractor should promptly inform the Union of any applicants hired from other sources, and such applicants shall register with the appropriate hiring hall, if any.
