Time for Submission of Grievance. A grievance must be submitted to the formal grievance procedure within: 1. Ten (10) calendar days after the grievant knows or should have known the facts giving rise to the grievance but in no case later than: 2. Thirty (30) calendar days following the date the incident occurred which gave rise to the grievance. Whichever of the above occurs first shall be the controlling deadline date. Any grievance filed more than thirty (30) calendar days after the date of the incident which gave rise to the grievance will be considered not to have existed. Any grievance filed more than ten (10) calendar days after the employee becomes aware of the facts will also be considered not to have existed. Any grievance failing to meet either of the above time limits shall not be subject to arbitration.
