Common use of TIME OF BEGINNING AND COMPLETION Clause in Contracts

TIME OF BEGINNING AND COMPLETION. Time is of essence of this Contract. 15.1 CONSULTANT shall commence Work as described in Exhibit A, AProposal@, upon receipt of written Authorization to Proceed. CONSULTANT agrees to coordinate with CITY as to scheduling and mutually satisfactory completion of the services set forth in Exhibit A. 15.2 CONSULTANT shall adhere to schedules and deadlines agreed to by CITY and CONSULTANT. CONSULTANT=s failure to complete the Services within the time specified, due to avoidable delays, may at the CITY=s discretion be considered a material breach of this Agreement. No extension of time to complete any portion of the services called for in this Agreement shall be allowed except upon the express, written approval of the Designated Representative. Consultant shall request, in writing, a time extension for approval by CITY, promptly upon the occurrence of any action causing delay in CONSULTANT=s prosecution of the services. The nature of the delay, the corrective actions taken and the impacts on the project schedule shall be described in each request for time extension.

CONSULTANT shall adhere to schedules and deadlines agreed to by CITY and CONSULTANT. CONSULTANT=s ’s failure to complete the Services within the time specified, due to avoidable delays, may at the CITY=s ’s discretion be considered a material breach of this Agreement.
