Time of interpretation. Interpretation of the disclosure is by reference to the knowledge of the skilled person in the field at the relevant date. A prior art document must be construed as it would have been construed by the skilled person at the date on which it was published. In the case of unpublished documents (Article 54(3) EPC), the relevant date is the date of filing or the priority date, where appropriate.
Time of interpretation. Any terms of coverage of this policy, including exclu- sions, shall be construed and applied based on the facts existing on the date of the “occurrence” causing “bodily injury” or “property damage”.
