Common use of Time of Service Clause in Contracts

Time of Service. 25.3.1 A notice or other communication is taken to be delivered: (a) if delivered personally or left at the person's address, upon delivery; (b) if posted within Australia to an Australian address: (i) using express post, 2 Business Days after posting; and (ii) using any other prepaid post, 6 Business Days after posting; (c) if posted to an address in a different country, 10 Business Days after posting; and (d) if delivered by email, at the time the email left the sender's email system, unless the sender receives notification that the email was not received by the recipient. 25.3.2 Despite clause 25.3.1, a notice or other communication which is received after 5.00pm or on a non-business day (each in the place of receipt), is taken to be delivered at 9.00am on the next business day in the place of receipt.
