Common use of Title and Capacity Clause in Contracts

Title and Capacity. The Company and Executive hereby agree to continue the Executive’s employment with the Company, effective as of the Effective Date, under the terms set forth in this Agreement. The Executive will continue to serve as the Senior Vice President and Chief Financial Officer of the Company, reporting to the Company’s Chief Executive Officer. During the Executive’s employment with the Company, the Executive will devote substantially all of Executive’s business time and attention to the business of the Company, except for vacation periods and reasonable periods of illness or other incapacities permitted by the Company’s general employment policies, or as otherwise set forth herein.

During the Executive’s employment with the Company, the Executive will devote substantially all of Executive’s business time and attention to the business of the Company, except for vacation periods and reasonable periods of illness or other incapacities permitted by the Company’s general employment policies, or as otherwise set forth herein.

Title and Capacity. The Company hereby agrees to employ the Executive, and the Executive hereby agree to continue the Executive’s accepts employment with the Company, effective as of the Effective Start Date, under the terms set forth in this Agreement. The Executive will continue to serve in an executive capacity as the Senior Vice President Chief Medical Officer and Chief Financial Development Officer of the Company, reporting to the Company’s Chief Executive Officer. During the Executive’s employment with the Company, the Executive will devote substantially all of Executive’s business time and attention to the business of the Company, except for vacation periods and reasonable periods of illness or other incapacities permitted by the Company’s general employment policies, or as otherwise set forth herein.
