TITLE CONDITIONS. The following special conditions imposed by Combined Developers (Pty) Ltd in its favour and the favour of the HOA, will be registered against the title deed of the Property, namely:
TITLE CONDITIONS. The Tenant must: comply with any title conditions (which includes servitudes) relating to the Estate[ or any larger development of which the Estate forms part]; do nothing which would cause the Landlord to be in breach of such title conditions; and not exercise any right which the Tenant may have to enforce any title condition relating to the Premises against a third party without the Landlord's consent. Where the Tenant makes any application to the Landlord for consent or approval under this Lease, the Tenant must provide to the Landlord all the information the Landlord requires to enable the Landlord to consider the application. The Tenant must, if required by the Landlord, provide the Landlord on a [quarterly] [annual] basis, all data relative to the Environmental Performance of the Premises that the Tenant holds, such data to be delivered: in a form which provides meaningful and useful information; and using an industry accepted methodology, agreed by the Landlord and the Tenant (each being bound to act reasonably), to ensure consistency of the data. The Landlord undertakes to keep any such disclosed data confidential and only to use it to comply with any Legal Requirement.

TITLE CONDITIONS. All covenants, agreements, restrictions, easements and declarations of record on the date hereof so far as the same may be from time to time in force and applicable.
TITLE CONDITIONS. 12.1 The Property is sold subject to all conditions and servitudes contained in the title deeds or prior title deeds of the Property and such conditions imposed by any competent authority when approving the rezoning and subdivision of the xxxxx on which the Development takes place.
12.2 The Seller shall be responsible for pointing out or indicating the position of the beacons or pegs in respect of the Erf to the Purchaser once only.
12.3 If the Erf has been erroneously described herein, such mistake or error shall not be binding upon the Parties, but the correct description as intended by the Parties shall apply and it shall be deemed that this contract has been rectified accordingly.
12.4 The Erf shall be fully serviced.
12.5 Should the boundaries of the Erf hereby sold differ in minor respects from the boundaries as shown on the Locality Plan, or the number of the Erf being altered, the Purchaser shall take transfer of the Erf as finally surveyed and renumbered. In such case the Seller shall not profit by any excess, nor shall the Seller be liable for any non-material deficiency in the area of the Erf.
TITLE CONDITIONS. 29.1 The Seller shall not be answerable for any deficiency in the declared extent of the Unit and/or the land, and no warranties are given in respect of the boundaries of the Unit and/ or the Property, subject to clauses 19 and 21 above.
29.2 The Purchaser shall accept transfer of the Unit subject to the Rules and all title conditions and servitudes benefiting or burdening same and the Property whether existing or hereinafter imposed by any competent authority or by the Seller.
29.3 The Purchaser acknowledges and agrees that he has acquainted himself with the proposed Rules of the Scheme, a copy whereof has been furnished to the Purchaser, it being agreed that the Seller shall be entitled to modify or add to such Rules prior to the opening of the Register provided that such modification or addition does not prejudice the rights of the Purchaser in terms of this Agreement.

TITLE CONDITIONS. As of expiration of the Diligence Period, Developer shall have determined that the Title Insurer shall: (i) insure, for its fair market value, as applicable, marketable, fee simple title to and/or leasehold estate in the Project Site in the name of Developer, free of all Title Defects, other than those Title Defects that City commits to cure or remove at or before the Closing but subject to the Permitted Exceptions and such other matters as Developer is deemed to have waived pursuant to the terms and conditions of this Agreement; and (ii) issue such endorsements as Developer reasonably deems to be necessary or appropriate.
