Common use of Title guarantee Clause in Contracts

Title guarantee. 4.3.1 The Lease shall be granted with full title guarantee but the Landlord's covenants for title shall be modified as set out. 4.3.2 Where the Property is let with full title guarantee: (i) the covenants set out in sections 2 and 3 of the Law of Property (Miscellaneous Provisions) Xxx 0000 shall not extend to matters which are referred to in this Agreement or which would be revealed by searches and enquiries of public records or matters which would be revealed by an inspection or survey of the Property (the sale being expressly made subject to all of them); and (ii) the covenant set out in section 2(1)(b) of that Act shall not extend to any action required of the Landlord unless the Tenant pays the Landlord's costs.
