Title to Right Sample Clauses

Title to Right of-Way TxDOT shall hold title to all Project right-of-way. Developer and other third parties may obtain leasehold or other real property rights (such as easements) for Project right-of- way or portions thereof acquired for a Facility as set forth in an approved Facility Implementation Plan or Facility Financial Plan. TxDOT shall have no obligation to acquire any Project right-of-way until such time as TxDOT agrees to acquire right-of- way as set forth in an approved Facility Implementation Plan. Project right-of-way shall be acquired in accordance with applicable Law.

  • Termination This Agreement may be terminated at any time prior to the Closing:

Any real property and facilities held under lease by the Company or any of its Subsidiaries are held by them under valid, subsisting and enforceable leases with such exceptions as are not material and do not interfere with the use made and proposed to be made of such property and buildings by the Company and its Subsidiaries.
