Common use of Tort and Contract Claims Clause in Contracts

Tort and Contract Claims. Any other claim or liability (including litigation identified in Schedule 4.17), whether in contract or tort, which arises from the conduct of Seller or in the operation of the Licensed Operations prior to the Closing Date.
