Tract 5 Option to not Participate. The grantees, owners, successors and/or assigns of Tract 5 shall have the option to withdraw from this Declaration as to Easement C only. In order to exercise such option, the grantees, owners, successors and/or assigns of Tract 5 shall first have obtained access to the private road described in Easement A by constructing a driveway, approved by the Developer. connecting Tract 5 to Easement A. The owners of Tracts 5, 6, 7, and 8 shall cause to be recorded in the office of the Clay County Clerk a termination of easement in which the owner of Tract 5 shall release and quitclaim all of its right, title and interest in and to Easement C, and the owners, successors and/or assigns of Tract 5 shall thereafter have no right to use the permanent access easement for ingress and egress to Lot 5. Section III.2. hereof shall be amended so that the grantees, owners, successors and/or assigns of Lots 6 and 7 shall then each be responsible for one-half (1/2) of the cost of repair, maintenance, construction or reconstruction, including the costs of returning the premises to the prior condition, with respect to the permanent access easement.

  • Option to Renew Provided Tenant is not, and has not been (more than two (2) times), in default under any of the terms and conditions contained herein, Tenant shall have two (2) additional consecutive five (5) year options to renew and extend the Rental Term as provided herein (“Option”). Within thirty (30) days of Option Notice, Tenant shall notify Landlord of Tenant’s option of Fair Market Rate for the applicable renewal period. If Landlord disagrees with Tenant’s opinion of the Fair Market Rate, Landlord shall notify Tenant of Landlord’s opinion of Fair Market Rate within fifteen (15) days after receipt of Tenant’s opinion of Fair Market Rate (“Landlord’s Value Notice”). If the parties are unable to resolve their differences within thirty (30) days thereafter, Landlord or Tenant, at its sole option, may terminate this Lease, effective as of the last day of the then-current Rental Term. Alternatively, Tenant and Landlord may mutually agree to submit the determination of Fair Market Rate to a “Market Assessment Process,” as provided in Exhibit “F” – Market Assessment Process.

  • POPULATION TO BE SERVED A. In accordance with the Contract, Contractor is required, within the limits of the Contractor’s service capacity, to serve individuals who meet the financial and clinical eligibility criteria for an adult who is Seriously Mentally Ill (SMI) and is eligible for services as described in the DARMHA manual.

Except for Stand Alone System Upgrade Facilities, Developer shall have no right to construct System Upgrade Facilities under this option.
