Common use of TRANSFER AND PLACEMENT Clause in Contracts

TRANSFER AND PLACEMENT. (a) Unless the transfer is effected at the request of the teacher, and subject to the procedures in paragraph 21.03 below, Hillel Academy shall not transfer a teacher from one teaching assignment to another teaching assignment until there has been an opportunity for a meeting between the teacher concerned and the Director of Education for purposes of discussion of all the implications of such transfer as known to the parties, at least ten (10) school days prior to the transfer, except in the case of an emergency when only five (5) consecutive days notice of the transfer shall be required. (b) A teacher may choose not to have the meeting referred to in subparagraph 21.01(a) convened. (c) A transfer of a teacher not requested by the teacher shall not adversely affect the teacher's annual salary paid to him immediately prior to the date of the transfer as stated in the teacher's Contract of Employment pursuant to paragraph 6.02 herein so that if the effect of the transfer would otherwise be to cause the teacher's salary to be reduced, Hillel Academy shall, at the effective date of the transfer, continue to pay the teacher his salary in effect immediately prior to the transfer according to the appropriate salary grids in Article 8, provided that nothing there herein contained shall be construed to prevent a transfer from increasing the teacher's annual salary. 21.02 The following procedures shall govern when a vacancy occurs in the system: (a) The Director of Education shall, not later than May 31, post a list of known vacancies which will exist in Hillel Academy as of the next 1st of September. The Director of Education shall advise of all vacancies and new positions as they occur during the year to HATA. (b) All teachers, including those returning from leave of absence, may apply for the vacancies published by Hillel Academy. (c) Hillel Academy shall give preference to applicant employees considered qualified and capable to fill the position concerned. (d) Where a teacher employee has been selected by Hillel Academy to fill a vacancy, that teacher's former position in turn shall be declared vacant and posted by Hillel Academy as a vacancy as soon as possible. (e) All teachers on staff at the end of the school year who will be employed by Hillel Academy for the next school year shall be given notice in writing from the Board of their tentative placement and teaching assignment at least ten (10) school days before the end of the term. (f) The Director of Education shall prepare and post in Hillel Academy, a tentative school organization for the following September, no later than the last day of school.
