Compassionate Care Leave Sample Clauses

Compassionate Care Leave. An employee who has been employed for at least thirty (30) days is entitled to an unpaid compassionate care leave of up to twenty-eight (28) weeks to provide care or support to a seriously ill family member. The employee must also provide a medical certificate stating that the eligible family member has a serious medical condition with a “significant risk of death within twenty-six (26) weeks”, and that the family member requires care or support from one or more family members, as defined by Employment Standards Code.
Compassionate Care Leave. An employee who is entitled to compassionate care benefits under the Employment Insurance Act is entitled to a leave of absence without pay of up to eight weeks for the purpose of providing care or support to a gravely ill family member at risk of dying within 26 weeks. Notwithstanding Clause 11.3 (a), there will be no interruption in the accrual of seniority or eligibility for benefits provided for under Article 25. The parties agree that the definition of "family member" for the purposes of this article only will be as per the applicable EI Act.

(c) Subject to any changes to the employee's status which would have occurred had he or she not been on compassionate care leave, the employee shall be reinstated to her former duties, on the same shift in the same department, and at the same rate of pay. (d) The employee and the Hospital will continue to pay their respective shares of the benefits and pension premiums.

Such request will be considered in light of operational requirements and will not be unreasonably denied.

Compassionate Care Leave. An employee shall receive compassionate care leave without pay to provide care or support to a seriously ill family member, subject to the following conditions: (A) An employee must have completed at least thirty (30) days of employment as of the intended date of leave. (B) An employee who wishes to take a leave under this section must give the employer notice of at least one (1) pay period, unless circumstances necessitate a shorter period. (C) An employee may take no more than two (2) periods of leave, totaling no more than eight (8) weeks, which must end not later than twenty-six (26) weeks after the day the first period of leave began. No period of leave may be less than one (1) week’s duration. (D) For an employee to be eligible for leave, a physician who provides care to the family member must issue a certificate stating that: (1) A family member of the employee has a serious medical condition with a significant risk of death within twenty-six (26) weeks from: (i) The day the certificate is issued, or (ii) If the leave was begun before the certificate was issued, the day the leave began; and (2) The family member requires the care or support of one (1) or more family members. The employee must give the Employer a copy of the physician’s certificate as soon as possible. (E) A family member for the purpose of this article shall be defined as: (1) A spouse or common-law partner of the employee; (2) A child of the employee or a child of the employee’s spouse or common-law partner; (3) A parent of the employee or a parent of the employee’s spouse or common-law partner; (4) A brother, sister, step-brother, step-sister, uncle, aunt, nephew, niece, grandchild or grandparent of the employee or of the employee’s spouse or common-law partner; (5) A current or former xxxxxx parent of the employee or of the employee’s spouse or common-law partner; (6) A current or former xxxxxx child, xxxx or guardian of the employee, or of the employee’s spouse or common-law partner; (7) The spouse or common-law partner of a person mentioned in any of the clauses (3), (4) (5) and (6); (8) Any other person whom the employee considers to be like a close relative, whether or not they are related by blood, adoption, marriage or common-law relationship. (F) An employee may end their compassionate leave earlier than eight
