TRANSFER OF RIGHTS OF RECOVERY TO US. If the insured has rights to recover all or part of any payment we have made under this policy, those rights are transferred to us. The insured must do nothing to impair them. At our request, the insured will bring suit or transfer those rights to us and help us enforce them.

TRANSFER OF RIGHTS OF RECOVERY TO US. If we make payment under this insurance, you, your customers, or the owner of the covered property rights to recover damages from another are transferred to us to the extent of our payment. You, your customers, or the owner of the covered property must do everything reasonably necessary to secure our rights and must do nothing knowingly after loss to impair our rights. After you, your customers, or the owner of the covered property has been made whole, all amounts recovered by the from third parties for which you, your customers, or the owner of the covered property also received benefits under this Policy, shall be paid to us by the Policyholder up to the total amount of benefits paid by us.

  • Reservation of Rights NYISO and Connecting Transmission Owner shall have the right to make unilateral filings with FERC to modify this Agreement with respect to any rates, terms and conditions, charges, classifications of service, rule or regulation under section 205 or any other applicable provision of the Federal Power Act and FERC’s rules and regulations thereunder, and Developer shall have the right to make a unilateral filing with FERC to modify this Agreement pursuant to section 206 or any other applicable provision of the Federal Power Act and FERC’s rules and regulations thereunder; provided that each Party shall have the right to protest any such filing by another Party and to participate fully in any proceeding before FERC in which such modifications may be considered. Nothing in this Agreement shall limit the rights of the Parties or of FERC under sections 205 or 206 of the Federal Power Act and FERC’s rules and regulations thereunder, except to the extent that the Parties otherwise mutually agree as provided herein.
