Transfer Within the Unit. An employee awarded a transfer or promotion to another position within the bargaining unit may elect to return to his former classification and rate of pay, without loss of seniority, during the probationary period of the new position. The Employer may disqualify an employee during the probationary period of the new position, if the Employer determines the employee lacks the ability to do the job. If disqualified during the probationary period, the employee will return to his former classification and rate of pay, without loss of seniority to an available vacancy. If no vacancy exists, the employee may be assigned to replace a probationary employee of the Employer’s selection. If there is no probationary employee, the employee shall replace the least senior employee in his/her classification.
