Common use of Transfers by the Employer Clause in Contracts

Transfers by the Employer. Transfer of an employee may take place only under the following three circumstances and only so long as conditions 1 through 12 below are satisfied: • The alternative would be a layoff due to a lack of work or lack of funds; or • A bona fide reorganization is planned in an area, based upon changing needs or priorities of the University; or • Other personnel factors including appropriate staffing levels, maximizing the effectiveness of employees and reducing conflicts within work locations as well as any other good cause which enhances the operational effectiveness of the University and its employees. If this reason is cited, any transfer must be preceded by a labor-management meeting if requested by the Union.
