6.9.1.5 A list of wire centers meeting the criteria set forth in Section 6.9.1.4 above as of March 10, 2005, ("Initial List") Intial Wire Center List is available on set forth in Exhibit D hereto or as modified by a subsequent notification via BellSouth's Interconnection Services Web site at xxx.xxxxxxxxxxxxxxx.xxxxxxxxx.xxx’s web site.
6.9.1.6 Notwithstanding the Effective Date of this Agreement, during the Transition Period, the rates for MRCITC^DeltaCom’s Embedded Base of Dark Fiber Transport as described in Section 6.9.1.2 above shall be as set forth in Exhibit B and the rates for MRCITC^DeltaCom’s Embedded Base of Dark Fiber Transport Entrance Facilities as described in Section 6.9.1 above shall be as set forth in Exhibit A.A. On or after December 1, 2005, BellSouth shall xxxx to ITC^DeltaCom the amount owed for the Embedded Base of Dark Fiber Transport and the Embedded Base of Dark Fiber Transport Entrance Facilities for the period from March 11, 2005 to the Effective Date, and ITC^DeltaCom shall pay such amount according to payment processes set forth in Attachment 6 of this Agreement.

6.9.1.6 Notwithstanding through the Effective Date completion of this Agreement, during the Transition Period, the rates BellSouth shall charge a rate for MRCDeltaCom’s Embedded Base and Excess of Dark Fiber Transport as described in Section 6.9.1.2 and Embedded Base Dark Fiber Transport Entrance Facilities shall be equal to the higher of:

6.9.1.7 5.9.1.7 The Transition Period shall apply only to MRCDeltaCom’s Embedded Base of Dark Fiber Transport and Dark Fiber Entrance Facilities. 6.9.1.9.1 5.9.1.9.1 If MRC DeltaCom fails to submit the spreadsheet(s) specified in Section 6.95.9.1.9 above for all of its Embedded Base prior to June 10, 2006 or by some other mutually agreed upon date, BellSouth will identify DeltaCom’s remaining Embedded Base, if any, and will transition such circuits to the equivalent tariffed BellSouth service(s). Those circuits identified and transitioned by BellSouth pursuant to this Section 5.9.
1.9.1 shall be subject to the applicable switch-as-is charges as set forth in this Agreement and, only where physical rearrangements are necessary, the full nonrecurring charges for installation of such BellSouth services as set forth in BellSouth’s tariffs shall apply to such circuits.
5.9.1.9.2 For Embedded Base circuits converted pursuant to Section 5.9.1.9 above or transitioned pursuant to Section 5.9.1.9.1 above, the applicable recurring tariff charge shall apply to each circuit as of September 11, 2006.
5.9.1.9.3 To the extent that DeltaCom no longer desires to provide a particular service, it must notify BellSouth of its intent to discontinue and the parties must coordinate the disconnect to take place prior the conclusion of the applicable transition period. DeltaCom must also adhere to Commission Rule R17-2(q) regarding the discontinuance of service to customers.

Transition for Dark Fiber Transport and Dark Fiber Transport Entrance Facilities. 6.9.1.1 For purposes of this Section 6.9, the Transition Period for the Embedded Base of Dark Fiber Transport is the eighteen (18) month period beginning March 11, 2005 and ending September 10, 2006.

6.9.1.3 For purposes of this Section 6.9, a Business Line is as defined in 47 C.F.R. § 51.5.
6.9.1.4 Notwithstanding anything to the contrary in this Agreement, BellSouth shall make available Dark Fiber Transport as described in this Section 6.9 only for MRCBTI’s Embedded Base during the Transition Period:
6.9.1.4.1 Dark Fiber Transport where both wire centers at the end points of the route contain 24,000 twenty-four thousand (24,000) or more Business Lines or three (3) or more fiber-based collocators.
6.9.1.5 A list of wire centers meeting the criteria set forth in Section 6.9.1.4 above as of March 10, 2005, ("Initial List") Intial Wire Center List is available on set forth in Exhibit C hereto or as modified by a subsequent notification via BellSouth's Interconnection Services Web site at xxx.xxxxxxxxxxxxxxx.xxxxxxxxx.xxx’s web site.
6.9.1.6 Notwithstanding the Effective Date of this Agreement, during the Transition Period, the rates for MRCBTI’s Embedded Base of Dark Fiber Transport as described in Section 6.9.1.2 above shall be as set forth in Exhibit B and the rates for MRCBTI’s Embedded Base of Dark Fiber Transport Entrance Facilities as described in Section 6.9.1 above shall be as set forth in Exhibit A.A. On or after December 1, 2005, BellSouth shall xxxx to BTI the amount owed for the Embedded Base of Dark Fiber Transport and the Embedded Base of Dark Fiber Transport Entrance Facilities for the period from March 11, 2005 to the Effective Date, and BTI shall pay such amount according to payment processes set forth in Attachment 7 of this Agreement.
6.9.1.7 The Transition Period shall apply only to MRCBTI’s Embedded Base of Dark Fiber Transport and Dark Fiber Entrance Facilities. MRC BTI shall not add new Dark Fiber Transport as described in this Section 6.9 except pursuant to the self-certification process as set forth in Section 1.8 of this Attachment above and as set forth in Section 6.9.1.10 below. Further, MRC BTI shall not add new Dark Fiber Entrance Facilities pursuant to this Agreement.
6.9.1.8 Once a wire center exceeds either of the thresholds set forth in this Section 6.9.1.46.9.1.4 above, no future Dark Fiber Transport unbundling will be required in that wire center.
6.9.1.9 No later than June 10, 2006 MRC BTI shall submit spreadsheet(s) identifying all of the Embedded Base of Dark Fiber Transport and Dark Fiber Entrance Facilities to be either disconnected or converted to other BellSouth services as Conversions pursuant to Section 1.61.6 above. The Parties shall negotiate a project schedule for the Conversion of the Embedded Base.

Transition for Dark Fiber Transport and Dark Fiber Transport Entrance Facilities. 6.9.1.1 For purposes of this Section 6.9, the Transition Period for the Embedded Base of Dark Fiber Transport is the eighteen (18) month period beginning March 11, 2005 and ending September 10, 2006.
6.9.1.2 For purposes of this Section 6.9, Embedded Base means Dark Fiber Transport that was in service for MRC U-Dial as of March 10, 2005 in those wire centers that, as of such date, met the criteria set forth in 6.9.
1.4.1. Subsequent disconnects or loss of End Users shall be removed from the Embedded Base.
6.9.1.3 For purposes of this Section 6.9, a Business Line is as defined in 47 C.F.R. § 51.5.
6.9.1.4 Notwithstanding anything to the contrary in this Agreement, BellSouth shall make available Dark Fiber Transport as described in this Section 6.9 only for MRCU-Dial’s Embedded Base during the Transition Period:
6.9.1.4.1 Dark Fiber Transport where both wire centers at the end points of the route contain 24,000 or more Business Lines or three (3) or more fiber-based collocators.
6.9.1.5 A list of wire centers meeting the criteria set forth in Section 6.9.1.4 above as of March 10, 2005, ("Initial List") is available on BellSouth's Interconnection Services Web site at xxx.xxxxxxxxxxxxxxx.xxxxxxxxx.xxx.
6.9.1.6 Notwithstanding the Effective Date of this Agreement, during the Transition Period, the rates for MRCU-Dial’s Embedded Base of Dark Fiber Transport as described in Section 6.9.1.2 shall be as set forth in Exhibit B and the rates for MRCU- Dial’s Embedded Base of Dark Fiber Transport Entrance Facilities as described in Section 6.9.1 shall be as set forth in Exhibit A.
6.9.1.7 The Transition Period shall apply only to MRCU-Dial’s Embedded Base of Dark Fiber Transport and Dark Fiber Entrance Facilities. MRC U-Dial shall not add new Dark Fiber Transport as described in this Section 6.9 except pursuant to the self-certification process as set forth in Section 1.8 of this Attachment and as set forth in Section 6.9.1.10 below. Further, MRC U-Dial shall not add new Dark Fiber Entrance Facilities pursuant to this Agreement.
6.9.1.8 Once a wire center exceeds either of the thresholds set forth in this Section 6.9.1.4, no future Dark Fiber Transport unbundling will be required in that wire center.
6.9.1.9 No later than June 10, 2006 MRC U-Dial shall submit spreadsheet(s) identifying all of the Embedded Base of Dark Fiber Transport and Dark Fiber Entrance Facilities to be either disconnected or converted to other BellSouth services as Conversions pursuant to Section 1.6. The Parties shall negotiate a project schedule for the Conversion of the Embedded Base.
6.9.1.9.1 If MRC U-Dial fails to submit the spreadsheet(s) specified in Section 6.9.
