Transition Period For Dark Fiber Transport. For an 18-month period beginning on March 11, 2005, any Dark Fiber Transport UNE that RNK leased from Verizon as of that date, but which Verizon is not obligated to unbundle pursuant to Section 3.5.3.1 above, shall be available for lease from Verizon at a rate set forth in the Pricing Attachment to this Amendment, which shall be equal to the higher of (a) 115% of the rate RNK paid for the Dark Fiber Transport element on June 15, 2004, or (b) 115% of the rate the Department has established or establishes, if any, between June 16, 2004, and March 11, 2005, for that Dark Fiber Transport element.
