End User represents that it owns or has acquired the necessary rights to use and/or transfer any such communications and/or content. End User further represents that End User shall not make available any Content in violation of any third party’s intellectual property or other proprietary rights.
Transmitted Content. TSC shall not be responsible in any way for the content of the programming transmitted by Customer, and shall bear no liability for any consequence, legal, commercial or otherwise, that may arise from the transmission of any programming transmitted by means of the Services pursuant to this Agreement by Customer. TSC acknowledges the nature of the programming content to be transmitted by Customer by means of the Services and the Customer agrees that it will be, and will remain, in compliance with all relevant laws and regulations with respect to the transmission of such content, and will conduct its activities in respect of this Agreement so as to avoid the occurrence of any Legal Action.
