Common use of Transportation of Materials of Environmental Concern Clause in Contracts

Transportation of Materials of Environmental Concern. Since December 31, 2000, the Company has not used, handled, generated, produced, manufactured, treated, stored, disposed of, recycled or transported any Materials of Environmental Concern, whether on behalf of the Company or any other Person, in violation of any Environmental Laws, and there has been no Release or threatened Release of any Materials of Environmental Concern beneath or from any real property operated or, to the Company’s Knowledge and the Sellers’ Knowledge, formerly owned or operated by the Company.

Transportation of Materials of Environmental Concern. Since December 31, 20002009, none of the Company Companies has not used, handled, generated, produced, manufactured, treated, stored, disposed of, recycled or transported any Materials of Environmental Concern, whether on behalf of the any Company or any other Person, in violation of any Environmental Laws, and there has been no Release or threatened Release of any Materials of Environmental Concern in violation of any Environmental Laws beneath or from any real property leased, operated oror formerly leased, to the Company’s Knowledge and the Sellers’ Knowledge, formerly owned operated or operated owed by the any Company.

Since December 31, 20001999, the Company has not not, except as set forth in Schedule 3.13.6, used, handled, generated, produced, manufactured, treated, stored, disposed of, recycled or transported any Materials of Environmental Concern, whether on behalf of the Company or any other Person, in violation of any Environmental Laws, and there has been no Release or threatened Release of any Materials of Environmental Concern beneath or from any real property operated or, to the Company’s Knowledge and the Sellers’ Knowledge, or formerly owned or operated by the Company.
