Transporter Conditions Precedent. Notwithstanding anything else in this Agreement to the contrary, Transporter’s obligation to construct, own, operate, and/or acquire the Project Facilities, and to render the Firm Service is subject to the fulfillment or waiver by Transporter of each of the following conditions precedent (each a “Transporter Condition Precedent” and collectively the “Transporter Conditions Precedent”):
