Treatment of Loans From Members. (a) Loans by any Member to the Company shall not be considered Capital Contributions and shall not affect the maintenance of such Member’s Capital Account, other than to the extent provided in Section 3.04(a)(iii), if applicable. (b) In no event shall any Member be obligated to make loans to the Company under this Agreement. If the Company has a temporary need for funds, the Company may borrow such funds from, among others, one (1) or more of its Members on such terms and conditions as shall be agreed to by the Managers and such Member or Members.
