Common use of TRIBAL COURT JURISDICTION Clause in Contracts

TRIBAL COURT JURISDICTION. All claims, disputes or other matters in question between the MPTN and the Contractor arising out of or relating to this Agreement, or the breach thereof, which cannot be resolved through mediation, shall be heard by the Mashantucket Pequot Tribal Court (“Tribal Court”), which shall have exclusive jurisdiction to adjudicate such disputes. No additional parties shall be joined to such proceedings without the written consent of MPTN. Nothing in this Paragraph 19 or in this Agreement shall prohibit or in any way limit MPTN’s right to seek reimbursement of monies paid for Workers Compensation benefits or Health Benefits, whether MPTN seeks such reimbursement by intervening in a lawsuit pending in a state or federal court or by bringing an independent action in any court having jurisdiction thereof, including state and federal courts.
