Common use of Truck Shipments Clause in Contracts

Truck Shipments. For any shipments transported by motor carrier, Shipper agrees that Superior shall only be liable for damage, loss, or delay resulting from its negligence or fault and that its liability is limited to least of the following:  The value of the goods actually damaged, lost, or delayed;  U.S. $0.50 per pound (where no value is declared) multiplied times number of pounds that are actually damaged, lost, or delayed, but not less than U.S. $50.00 per shipment; or  In the case of a declared value, the declared value of the goods actually damaged, lost, or delayed.
