Common use of TxDOT Right to Issue Change Orders Clause in Contracts

TxDOT Right to Issue Change Orders. TxDOT may, at any time and from time to time, without notice to any Surety, authorize and/or require, pursuant to a Change Order, changes in the Work or in terms and conditions of the Technical Provisions (including changes in the standards applicable to the Work); except TxDOT has no right to require any change that: (a) is not in compliance with applicable Laws; (b) would contravene an existing Governmental Approval and such contravention could not be corrected by the issuance of a further or revised Governmental Approval; (c) constitutes a fundamental change in the nature or scope of the Project; (d) would cause an insured risk to become uninsurable; (e) would materially adversely affect the health or safety of users of the Project; (f) is fundamentally incompatible with the Project design; or (g) is not technically feasible to construct. DB Contractor shall have no obligation to perform any work within any such exception unless on terms mutually acceptable to TxDOT and DB Contractor.
