U se of the Wavelink Trademarks. Reseller will not alter or remove any of the Wavelink Trademarks affixed to or otherwise contained on or within the Wavelink Products. Except as set forth in this Section 11, nothing contained in this Agreement will grant or will be deemed to grant to Reseller any right, title, or interest in or to the Wavelink Trademarks. All uses of the Wavelink Trademarks will inure solely to Ivanti and Reseller will obtain no rights with respect to any of the Wavelink Trademarks, other than as expressly set forth in this Agreement, and Reseller irrevocably assigns to Ivanti all such right, title, and interest, if any, in any of the Wavelink Trademarks. At no time during or after the term of this Agreement will Reseller challenge or assist others to challenge the Wavelink Trademarks (except to the extent expressly required by applicable law) or the registration thereof or attempt to register any of the Wavelink Trademarks or marks or trade names that are confusingly similar to those of Ivanti. Upon termination of this Agreement, Reseller will immediately cease to use all the Wavelink Trademarks and any listing by Reseller of Wavelink’s name in any telephone book, directory, public record or elsewhere, will be removed by Reseller as soon as possible, but in any event not later than the subsequent issue of such publication.

  • Use of Intellectual Property The Adviser grants to the Sub-Adviser a sublicense to use the trademarks, service marks, logos, names, or any other proprietary designations of the Adviser (“AdvisorShares Marks”) on a non-exclusive basis. The Sub-Adviser will acquire no rights in the AdvisorShares Marks, and all goodwill of the AdvisorShares Marks shall inure to and remain with the Adviser. Notwithstanding the forgoing, the Sub-Adviser and its affiliates may, without obtaining the Adviser’s prior approval, refer directly or indirectly to its relationship with the Trust, the Fund(s), the Adviser or any of their respective affiliates and use AdvisorShares Marks in offering, marketing or other promotional materials provided that such materials were previously approved by the Adviser and remain in substantially the same form.

  • Use of Trademarks Subject to the terms and conditions hereof, Sponsor hereby represents and warrants that it has the power and authority to grant, and does hereby grant to Show Management a non-exclusive, nontrans- ferable, royalty-free, worldwide license to reproduce and display all logos, trademarks, trade names and similar identifying material relating to Sponsor (the ”Sponsor Marks”) solely in connection with the promotion, marketing and distribution of the parties in accordance with the terms hereof, provided, however, that Show Management shall, other than as specifically provided for in this Agreement, not make any specific use of any Sponsor Mark without first submitting a sample of such use to Spon- sor and obtaining its prior consent, which consent shall not be unreasonably withheld.
