THE ABOVE WARRANTY IS CUSTOMER’S EXCLUSIVE WARRANTY AND LIFESIZE DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OR CONDITIONS OF DESIGN, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES OF TITLE AND NON-INFRINGEMENT. EXCEPT AS EXPRESSLY PROVIDED IN THIS SECTION, CUSTOMER ACKNOWLEDGES THAT LIFESIZE PRODUCTS ARE PROVIDED “AS IS” AND FURTHER ACKNOWLEDGES THAT LIFESIZE DOES NOT WARRANT THAT (A) THE OPERATION OF LIFESIZE PRODUCTS WILL BE UNINTERRUPTED OR ERROR FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, (B) LIFESIZE PRODUCTS ARE NOT VULNERABLE TO FRAUD OR UNAUTHORIZED USE, OR (C) THE FEATURES OR FUNCTIONALITIES OF LIFESIZE PRODUCTS WILL BE AVAILABLE AT ANY TIME IN THE FUTURE. CUSTOMER IS RESPONSIBLE AND LIFESIZE SHALL HAVE NO RESPONSIBILITY FOR DETERMINING THAT CUSTOMER’S PROPOSED USE OF LIFESIZE PRODUCTS COMPLIES WITH APPLICABLE LAWS.
D isclaimer. Notwithstanding any other provision of this Agreement, the City is furnishing Proprietary Data on an “as is” basis, without any support whatsoever, and without representation, warranty or guarantee, including but not in any manner limited to, fitness, merchantability or the accuracy and completeness of the Proprietary Data. Licensee is fully and solely responsible for the condition of its radio both before and after any decryption or re- encryption. The City assumes no liability for any errors or omissions herein. Specifically, the City is not responsible for any costs including, but not limited to, those incurred as a result of lost revenues, loss of use of data, loss of use of hardware or equipment, the costs of recovering such programs or data, the cost of any substitute program, the cost of repair of hardware or equipment, claims by third parties, or for similar costs. If discrepancies are found, Licensee agrees to contact the City immediately.
D isclaimer. THE FOREGOING PROVISIONS OF THIS SECTION 8 STATE THE ENTIRE LIABILITY AND OBLIGATIONS OF IVANTI AND THE EXCLUSIVE REMEDY OF RESELLER AND END USERS, AND IVANTI, RESPECTIVELY, WITH RESPECT TO ANY ALLEGED PATENT, COPYRIGHT, TRADEMARK, OR OTHER INTELLECTUAL PROPERTY INFRINGEMENT BY THE WAVELINK PRODUCTS.

THE PARTIES ARE NOT RELYING AND HAVE NOT RELIED ON ANY REPRESENTATIONS OR WARRANTIES WHATSOEVER REGARDING THE SUBJECT MATTER OF THIS AGREEMENT, EXPRESS OR IMPLIED. OKTA MAKES NO WARRANTY REGARDING ANY NON-OKTA APPLICATION WITH WHICH THE SERVICE MAY INTEROPERATE.
D isclaimer. 10.1. To the fullest extent permitted by law, neither Xxxxx nor the Publisher, except as expressly set forth in this agreement makes any warranties, express or implied, with respect to the subject matter of this agreement and each party expressly disclaims the implied warranties of merchantability, noninfringement, fitness for a particular purpose. Without limiting the generality of the foregoing, the Ogury SDK, Service and Platform are provided “as is” and without warranties of any kind. Ogury and its supplies, licensors and partners do not warrant that the functions contained in the Ogury SDK, Service or Platform will be correct, uninterrupted or error-free, that defects will be corrected, or that the Ogury Service, Platform or the servers that make it available are free of viruses or other harmful components. Except as expressly set forth herein, Ogury makes no guarantee regarding the number, quality, or content resulting from the Ogury Service, or Platform or the timing of delivery. Ogury reserves that right at all times, at its discretion, and without notice, to remove or refuse to distribute any item pertaining to the Ogury SDK, Service or Platform. Ogury does not warrant the results of the use of the Ogury SDK, Service or Platform. Publisher acknowledges that Ogury may modify or suspend the Ogury SDK, Service or Platform at any time in its sole discretion and without notice
10.2. Xxxxx assumes no responsibility of liability whatsoever for the content of the ads and Publisher understands that Xxxxx does not produce ad content but rather facilitates interactions between publishers and advertisers by providing targeted advertisements on behalf of advertisers to the end users of the Publisher’s Application.
D isclaimer. By its nature, the Licensed Software may contain errors, bugs, and other problems that could cause system failure. In addition, the Licensed Software may not have any documentation, and any documentation in existence may be inaccurate or incomplete. EXCEPT AS SET FORTH HEREIN, CLIENT PROVIDES THE LICENSED SOFTWARE AND ANY RELATED DOCUMENTATION TO LICENSEE ON AN “AS-IS” BASIS WITHOUT WARRANTY OF ANY KIND, AND CLIENT MAKES NO WARRANTY REGARDING THE LICENSED SOFTWARE, ANY RELATED DOCUMENTATION, OR THE USE OR OPERATION OF THE LICENSED SOFTWARE, AND SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR OTHERWISE, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, AND NON-INFRINGEMENT. LICENSEE MAKES NO WARRANTY REGARDING ANY FEEDBACK PROVIDED HEREUNDER AND SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED OR OTHERWISE.

Except for the foregoing limited warranties, and to the maximum extent permitted by law, Memberium disclaims all other warranties, express, implied, or statutory (including warranties of merchantability, fitness and non-infringement), related to the benefits, solutions and services provided under a Program Addendum.
