UK (Scotland Sample Clauses

UK (Scotland. The Data Protection Act of 1998 (1) The processing is necessary for medical purposes and is undertaken by (a) a health professional, or (b) a person who in the circumstances owes a duty of confidentiality which is equivalent to that which would arise if that person were a health professional....”. Medical purposes includes the purposes of preventative medicine, medical diagnosis, medical research, the provision of care and treatment and the management of healthcare services. So in summary, the Act allows transmission and storage of xxxxx xxxxx and therefore xxxxx xxxxx triage by anyone, given the client's consent (Schedule 2 paragraph 1 and Schedule 3 paragraph 1). It seems also possible (but probably no advantage) to have a contract with a client which includes care for medical purposes and to apply Schedule 2 paragraph 2 and Schedule 3 paragraph 8. Schedule 2 also allows processing if "6 (1) ... necessary for ... legitimate interests pursued by the data controller ... except where the processing is unwarranted" and allows the Secretary of State to specify what this means. Also, though section 57 seems to outlaw (a contract of) consent to use of any health record or extract of this, this applies only when the client himself has obtained the data from elsewhere, and so is not relevant here (Opsi, 1998).
