UNAUTHORIZED DISCLOSURE OF INFORMATION - INJUNCTION. If it appears that the Recipient has disclosed (or has threatened to disclose) Confidential Information in violation of this Agreement, the Owner shall be entitled to an injunction to restrain the Recipient from disclosing the Confidential Information in whole or in part. The Owner shall not be prohibited by this provision from pursuing other remedies, including a claim for losses and damages.

For a period of five (5) years after the end of the term of this Agreement, the Recipient will not attempt to do business with, or otherwise solicit any business contacts found or otherwise referred by Broker to Recipient for the purpose of circumventing, the result of which shall be to prevent the Broker from realizing or recognizing a profit, fees, or otherwise, without the specific written approval of the Broker. If such circumvention shall occur the Broker shall be entitled to any commissions due pursuant to this Agreement or relating to such transaction until the Broker sends the Recipient written notice releasing the Recipient from this Agreement.

UNAUTHORIZED DISCLOSURE OF INFORMATION - INJUNCTION. If it appears that the Recipient has disclosed (or has threatened to disclose) Confidential Information in violation of this Agreement, the Caucus shall be entitled to an injunction to restrain the Recipient from disclosing the Confidential Information in whole or in part. Recipient understands that the use or disclosure of any Confidential Information may be cause for an action at law in an appropriate court of the State of Indiana or any State of the United States, or in any federal court and that the Employer shall be entitled to an injunction prohibiting the use or disclosure of the Confidential Information. The Caucus shall not be prohibited by this provision from pursuing other remedies, including a claim for losses and damages.

UNAUTHORIZED DISCLOSURE OF INFORMATION - INJUNCTION. The Qualified Assessor understands and acknowledges that his/her obligations under this Agreement are necessary and reasonable to protect NRCA’s legitimate business interests and that monetary damages would be inadequate to compensate for any breach of this Agreement. Accordingly, the Qualified Assessor agrees that any such breach will cause immediate and irreparable injury to the NRCA for which there would be no adequate remedy at law. As such, the Qualified Assessor agrees that if he/she breaches any provision of this Agreement, NRCA shall be entitled to any proper injunction, including but not limited to temporary, preliminary, and final injunctions, temporary restraining orders, and temporary protective orders, without bond or security, to enforce this Agreement, in addition to any other remedies available to NRCA at law or in equity.
