Underpayment of Wages. 10 The Entity agrees that in the event of underpayment of wages to any employee on the Project, whether by the 11 Entity or any subcontractor on the Project, the District may retain from payments due to the Entity, an amount 12 sufficient to pay such worker the difference between the wages required to be paid by the DIR, and the wages 13 actually paid such worker for the total number of hours worked, plus any penalties and forfeitures.
