Union Representation of Members. While it is understood that the Union is unequivocally opposed to the use of alcohol or drugs in the workplace as well as, the abuse of such substances under any condition and further agrees to cooperate toward the prevention of such abuse and strongly supports the prohibition of the use of drugs or alcohol in the workplace and the proper enforcement of the Department’s rules and regulations, the Union, retains the right to fairly and properly represent any aggrieved member of the bargaining unit by reason of the application of this Article, including but not limited to what the Union may consider as unwarranted or unreasonable investigation, search or the imposition of discipline. Any employee receiving disciplinary action under Article 39 may appeal that action in accordance with the procedures outlined in the applicable Civil Service Law.
