Common use of Unlimited Liability Clause in Contracts

Unlimited Liability. Neither party will exclude or limit its liability for damages resulting from: a) unauthorized use or disclosure of Confidential Information, b) either party’s breach of its data protection and security obligations that result in an unauthorized use or disclosure of personal data,

Unlimited Liability. Neither party will exclude or limit its liability for damages resulting from: (a) the parties’ obligations under Section 8.1(a) and 8.2, (b) unauthorized use or disclosure of Confidential Information, b, (c) either party’s breach of its data protection and security obligations that result in an unauthorized use or disclosure of personal data, (d) death or bodily injury arising from either party’s gross negligence or willful misconduct, or (e) any failure by Customer to pay any fees due under the Agreement.

The parties’ indemnification obligations; c. Intentionally misappropriating the intellectual property rights of the other party; d.
