Common use of Unlimited Liability Clause in Contracts

Unlimited Liability. Notwithstanding the foregoing, nothing herein shall limit a party’s liability for: (A) death or personal injury caused by either party’s negligence; (B) its fraud or fraudulent misrepresentation; (C) Losses under Section 5.1 and Section 5.2; (D) its willful misconduct or gross negligence; or (E) liability that cannot be excluded by applicable law.

Unlimited Liability. Notwithstanding the foregoing, nothing herein shall limit a party’s Neither Party excludes or limits it liability for: (A) : death or personal injury caused by either party’s its negligence; , or that of its employees, agents or Sub-Contractors (B) as applicable); bribery or Fraud by it or its fraud employees; breach of any obligation as to title implied by section 2 of the Supply of Goods and Services Act 1982; or fraudulent misrepresentation; (C) Losses under Section 5.1 and Section 5.2; (D) its willful misconduct or gross negligence; or (E) any liability that to the extent it cannot be excluded or limited by applicable lawLaw.
