Use and Disclosure of Confidential Information. A party ("Recipient") which acquires Confidential Information of another party ("Discloser") will not: (a) use any of the Confidential Information except to the extent necessary to exercise its rights and perform its obligations under this Participation Agreement (which, for the avoidance of doubt, may include such disclosure to third parties subject to equivalent confidentiality obligations as is necessarily incidental to a Conveyancing Transaction); or (b) disclose any of the Confidential Information except in accordance with clauses 10.3 or 10.4 of this Participation Agreement.
